Terms of Service for Lexiage

Lexiage is a vocabulary-mastery platform for individuals, families, teachers, and schools. Features vary by subscription plan. We continually improve the platform and may add, change, or remove features; if a change materially reduces what a paid plan includes, we will notify account owners in advance.

• You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for activity on your account.
• Individual accounts require an email address and are intended for users old enough to consent for themselves under the law of their country. Children use Lexiage through accounts created and managed by a school, teacher, or parent.
• Schools and teachers: when you create student accounts, you warrant that you are authorized to do so and that you have obtained any parental consent your institution or local law requires. You manage your students' credentials and are responsible for distributing them appropriately.

• Paid plans are billed through our payment provider, Stripe, on a recurring basis (monthly or yearly, as selected at checkout). Prices are shown before purchase; applicable taxes may be added depending on your country.
• Free trials: where a plan includes a free trial, a valid payment method is required at signup, and the card on file is automatically charged when the trial ends unless you cancel before the trial's end. We send a reminder email before the trial ends.
• Cancellation: you can cancel at any time through the Stripe billing portal, reached from the "Manage Billing" option on your billing page. Cancellation stops future charges; your plan remains active until the end of the period already paid. Cancelling does not delete your data — see the Privacy Policy for data deletion.
• Failed payments: if a renewal payment fails, Stripe will retry it and email you to update your payment method. Access to paid features may be suspended while payment is outstanding.
• Withdrawal right (EU consumers): if you are an EU consumer you may have a 14-day right of withdrawal from a new purchase. By starting to use the paid service immediately, you request immediate performance; where you have used the service, any refund may be reduced proportionally, as permitted by law. Statutory consumer rights remain unaffected.
• School and institutional plans may have separate written terms agreed with the school; those prevail over this section where they conflict.

• You retain ownership of the content you create in Lexiage for your own private use.
• Community library license: if you choose to share a wordlist (or other content) with the Lexiage community, you grant Lexiage a perpetual, irrevocable, worldwide, royalty-free license to host, reproduce, adapt, display, and distribute that content as part of the Lexiage community library, including after your account is closed or deleted. Shared content becomes part of the community for the benefit of all users; if your personal data is deleted, shared content remains but is no longer attributed to you (your nickname is replaced with an anonymous placeholder).
• You must have the right to share anything you upload, and shared content must not contain personal information (yours or anyone else's), offensive material, or content that infringes others' rights. We may remove community content at our discretion.
• Learning-result metrics generated by your use of Lexiage may be retained in anonymized form to improve the platform, as described in the Privacy Policy.

You agree not to:

• share your account, resell access, or circumvent plan limits or feature gates;
• probe, scan, or test the vulnerability of Lexiage or any connected system, or breach or attempt to breach any security or authentication measure;
• disrupt, overload, or gain unauthorized access to the service, our infrastructure, or other users' data, or take any action that imposes an unreasonable or disproportionately large load on our systems;
• impersonate any person or entity, or misrepresent your affiliation with a person, school, or organization, including by forging identifying information in messages sent through Lexiage;
• scrape, bulk-download, or reproduce the Lexiage curriculum or community library outside the app;
• misuse AI features, including attempting to make the support chat or AI tools perform tasks outside their purpose;
• upload unlawful, offensive, or infringing content;
• reverse engineer the platform except where the law expressly permits it.

We may suspend or terminate accounts that violate these Terms, with notice where practicable. Schools are responsible for their students' compliance in the ordinary course of supervised use.

Parts of Lexiage's learning content (wordlists, feedback, support-chat answers) are generated by artificial intelligence and are labeled in the app. AI output may occasionally be inaccurate or imperfect; it is provided as a learning aid, not as authoritative reference material. The in-app support chat is available to teachers and school administrators only and answers questions about using Lexiage.

Flashing-content warning: Lexiage's learning modes display words that flash rapidly, in some modes at very high speed. If you (or a student in your care) have photosensitive epilepsy or are sensitive to flashing visuals, consult a doctor before use and supervise use appropriately.

We are working to improve Lexiage's accessibility across devices, including contrast and assistive-technology support, and we do not yet guarantee conformance with any specific accessibility standard. Feedback is welcome at [email protected].

The Lexiage platform, curriculum, design, and brand are the property of Lexiage or its licensors and are protected by law. Your subscription grants you a personal (or, for schools, institutional), non-exclusive, non-transferable right to use the service while your plan is active. No rights are granted except as stated in these Terms.

If you send us feedback, suggestions, or ideas about Lexiage — whether by email, the in-app support chat, or otherwise — you agree that it is given voluntarily and is not confidential. We may use it for any purpose, including to improve Lexiage, without any obligation or payment to you.

Lexiage may link to or integrate with third-party sites and services — for example, the Stripe billing portal, the CNPD website, or the Livro de Reclamações Eletrónico. We do not control these third-party sites and are not responsible for their content, policies, or practices. Visiting a linked site is at your own risk and subject to that site's own terms.

• We aim for high availability but do not guarantee uninterrupted or error-free operation; maintenance, updates, and events outside our control can cause interruptions.
• To the maximum extent permitted by law, Lexiage is provided "as is", and our total liability arising from or related to the service is limited to the amounts you paid to us in the twelve months before the event giving rise to the claim.
• Nothing in these Terms excludes or limits liability that cannot be excluded by law (including for intent or gross negligence), and nothing affects the statutory rights of consumers.

You agree to indemnify and hold harmless Lexiage, its officers, employees, and affiliates from any claims, losses, liabilities, and reasonable legal fees arising from your breach of these Terms, your misuse of the service, or content you upload that infringes the rights of a third party. This does not affect any right you have as a consumer that cannot be limited by agreement.

You may stop using Lexiage and cancel your plan at any time (Section 3). We may suspend or terminate access for material breach of these Terms, and will notify you where practicable. Sections that by their nature survive termination (including Sections 4, 8, 9, 11, and 12) survive.

We may update these Terms from time to time. We will post changes on this page and update the "Last updated" date; for material changes we will notify account owners by email in advance. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of Portugal. If you are a consumer in the EU/EEA, you also benefit from any mandatory protections of the law of your country of residence, and you may use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr). For any dispute not resolved that way or under mandatory consumer law, the competent courts are those of the Almada judicial district, Portugal — without prejudice to any right you have as a consumer to bring a claim in the courts of your own country of residence. Nothing in this section deprives consumers of the protection of mandatory local law.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect, and the unenforceable provision will be replaced with one that most closely reflects its intent. These Terms, together with the Privacy Policy, are the entire agreement between you and Lexiage about your use of the service, and supersede any prior agreements on the same subject. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms do not create rights for anyone other than you and Lexiage.
